Terms and Conditions

Welcome to Locus (“we,” “our,” or “us”) operated by Armastus Ltd. By accessing or using our mobile application (the “App”), website, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (the “Terms”). Please read them carefully before using the Services. If you do not agree with any part of these Terms, you must immediately discontinue using the Services.

1. Acceptance of Terms

By creating an account, accessing, or using the Services, you agree to:

         •       These Terms and our Privacy Policy, which describes how we collect, use, and protect your data.

         •       Any additional terms or policies referenced herein, including rules for using specific features and promotions.

If you do not agree to these Terms, do not use our Services.

2. Eligibility

To use our Services, you must:

         •       Be at least 18 years of age.

         •       Be legally permitted to use the Services under the laws of your country.

         •       Not be a convicted sex offender or be required to register as a sex offender with any government entity.

By using our Services, you represent and warrant that you meet all of these eligibility requirements. If we have reason to believe you are not eligible, we may suspend or terminate your account.

3. Account Registration and Security

         •       You must create an account to use our Services. When creating an account, you agree to provide accurate, complete, and current information about yourself.

         •       You are responsible for safeguarding your account login details and for any activities that occur under your account. You agree to notify us immediately if you suspect unauthorised use of your account.

         •       You may not create an account on behalf of another person, transfer your account, or share your account with others without our permission.

4. License and Restrictions

We grant you a personal, non-transferable, non-exclusive, revocable, and limited license to access and use our Services in accordance with these Terms.

You agree not to:

         •       Use the Services for any unlawful or fraudulent purposes.

         •       Copy, modify, distribute, or create derivative works of our content without our written consent.

         •       Upload, post, or transmit any content that is defamatory, obscene, offensive, or violates the rights of others.

         •       Interfere with, disrupt, or harm the Services or any servers or networks connected to the Services.

         •       Attempt to reverse engineer or decompile any part of the Services.

5. User Content, Conduct, and Responsibilities

You are responsible for the content that you post, upload, or transmit on the Services, including your profile information, photos, and messages exchanged with other users (“User Content”). By using the Services, you agree to the following responsibilities regarding your conduct and behavior:

5.1 Accurate Representation

         •       You will provide accurate, truthful, and up-to-date information in your profile and interactions with others.

         •       You will not misrepresent your identity, impersonate any person, or create false profiles.

5.2 Respectful Behavior

         •       You will behave appropriately and respectfully when interacting with other users, including in private messages, posts, and shared content. You will not harass, threaten, or insult other users.

         •       You agree to follow all applicable laws and behave in a manner that is safe, ethical, and respectful of others’ rights and dignity.

5.3 Personal Responsibility

         •       You are solely responsible for your interactions with other users, both online and offline. We do not screen or verify user identities, backgrounds, or intentions, so you agree to exercise caution and good judgment when communicating with others.

         •       You acknowledge that meeting others in person comes with inherent risks. If you choose to meet someone in real life, you are solely responsible for your safety. We recommend meeting in public places and informing a friend or family member of your plans.

5.4 Prohibited Behavior

         •       You will not upload, post, or share content that is illegal, harmful, defamatory, abusive, obscene, or discriminatory.

         •       You will not use the Services to promote any unlawful activities, including but not limited to human trafficking, hate speech, violence, or exploitation.

5.5 Reporting Misconduct

         •       You agree to report any inappropriate or illegal behavior of other users to us through the available reporting features in the App or through our support channels.

         •       We reserve the right to monitor user activity and take action against inappropriate behavior, including removing content, suspending, or terminating accounts. We may report misconduct to relevant authorities when deemed necessary.

6. Subscription Payments and Refunds

Some features of the Services may require payment (“Paid Features”). If you choose to use Paid Features:

         •       You agree to provide accurate payment information and authorize us (or our third-party payment processors) to charge your selected payment method for the applicable fees.

         •       Paid Features may be offered on a subscription basis with recurring charges. By purchasing a subscription, you agree that it is your responsibility to manage and cancel your subscription before the renewal date if you do not wish to be charged further.

         •       You may cancel your subscription at any time via your account settings or by following the cancellation instructions provided in the App. All purchases, including subscription payments, are non-refundable, unless required by applicable local law.

         •       We will comply with local laws and regulations in Switzerland, the UK, the USA, the EU, and India, which may mandate refunds under certain conditions, such as technical errors or failure to deliver the promised services.

7. User Safety Guidelines

While we strive to provide a safe environment, we cannot guarantee that all users will behave appropriately. You agree to:

         •       Use caution when interacting with others, especially if you choose to meet in person.

         •       Avoid sharing personal, financial, or sensitive information with other users.

         •       Immediately report any abusive, harmful, or inappropriate behavior to us through our support channels.

We reserve the right, but are not obligated, to investigate and take any action against users who violate these Terms, including suspension, account termination, or reporting to law enforcement authorities if we believe it is necessary to ensure user safety.

8. Dispute Resolution Process

8.1 Informal Resolution

We aim to resolve disputes quickly and amicably. In the event of any dispute, controversy, or claim arising from or related to these Terms or your use of the Services (each, a “Dispute”), you agree to first attempt to resolve the Dispute informally by contacting our support team at enquiries@locusdating.com within 30 days of the occurrence of the event giving rise to the Dispute.

We will attempt to resolve the Dispute through good-faith negotiations and will provide you with a written response within 30 business days.

8.2 Arbitration Agreement

If we are unable to resolve a Dispute through informal negotiations, you agree that the Dispute will be settled through binding arbitration, except for matters that qualify for small claims court or cases where injunctive or other equitable relief is sought.

         •       The arbitration will be conducted in accordance with the rules of a reputable arbitration body in your jurisdiction, such as:

         •       The American Arbitration Association (AAA) if you are located in the USA.

         •       The International Chamber of Commerce (ICC) or Swiss Arbitration Centre if you are located in Switzerland.

         •       The London Court of International Arbitration (LCIA) if you are located in the UK or the EU.

         •       An appropriate arbitration body governed by Indian arbitration law if you are located in India.

         •       The arbitration will be conducted in English (or in the relevant local language) by a single neutral arbitrator, and the location of arbitration will be in the jurisdiction where you reside unless otherwise mutually agreed upon by both parties.

         •       Arbitration will be confidential, and the arbitrator’s decision will be binding on all parties.

8.3 Waiver of Class Action

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, collective, consolidated, or representative action. You waive any right to participate in a class action lawsuit or a class-wide arbitration against us.

8.4 Small Claims

You may seek resolution of disputes in small claims court if your claim qualifies for such adjudication under the laws of your jurisdiction, without affecting your right to resolve disputes via arbitration.

8.5 Governing Law and Legal Venue

These Terms and any Disputes will be governed by and construed in accordance with the laws of:

         •       The United Kingdom if you reside in the UK.

         •       The United States and the laws of the state where you reside if you are located in the USA.

         •       The European Union (EU) and its member states if you reside in Europe, subject to the General Data Protection Regulation (GDPR).

         •       India under the Information Technology Act, 2000, and related privacy regulations if you reside in India.

         •       Switzerland, in accordance with the Swiss Federal Act on Data Protection (FADP) and related legislation, if you reside in Switzerland.

In the event of any Dispute not resolved through arbitration, the exclusive jurisdiction for the resolution of such disputes will be in the appropriate courts of the governing jurisdiction.

9. Termination and Account Suspension

We may, in our sole discretion, suspend or terminate your account at any time for any reason, including but not limited to:

         •       Violating these Terms, our Privacy Policy, or any other applicable policies.

         •       Engaging in harmful, inappropriate, or illegal behavior.

         •       Failing to comply with the eligibility requirements or providing false information.

You may also choose to delete your account at any time through the account settings in the App. Upon termination, you lose the right to access or use the Services. We may retain certain information as required by law or for legitimate business purposes, as outlined in our Privacy Policy.

By signing up for and using the Services, you confirm that you have read, understood, and agree to these Terms and Conditions, including the linked Privacy Policy.
